The Iridium network consists of 66 Low-Earth Orbiting satellites that continuously orbit the Earth, beaming connectivity into nearly every nook and cranny of our planet. It can do this because the satellites are constantly moving. However, because they are constantly moving, long-term connectivity in any given location is not guaranteed. Given this Iridium satellite phone rentals are best suited for short conversations and test messages.

IMPORTANT ADVICE:
Keep in mind that satellite phones require a direct line of sight link to the satellite. Buildings, mountains and other obstacles can block line-of-sight connectivity resulting in signal loss.
When using your Iridium satellite phone rental in mountainous areas, the signal will come and go as the satellites move in and out from behind mountains. In some severe cases you may experience very short windows of connectivity depending on your location.

Agreement

Usage of equipment and/or services signifies acceptance of these Chroma SATcom Terms and Conditions.

Rental Period

Start Date:
The rental period begins on the date that you receive your rental equipment (the requested rental start date) and continues for the amount of time that you purchased (for example, one week, two weeks, one month, etc.) when you placed your rental order.

Adding Rental Time

The rental period cannot be shortened. However it can be extended for additional days, weeks or months at the daily/weekly or monthly rates outlined on our then-current published rate card. Extensions must be agreed to in writing.

Shipping & Delivery

  • Chroma SATcom will use reasonable efforts to deliver the Equipment by the requested delivery time but it shall not incur any liability to the customer in the event of any delay. The customer will accept the equipment when delivered on or before the delivery time and if for any reason the Customer fails to accept the Equipment when delivered on or before such date the Customer shall nevertheless be liable for the stated charge in full.
  • Renter will ship all rental equipment back to Chroma on the final day of the rental period. A grace period of three (3) days will be added to the rental period to allow for return shipping time. The customer will ensure the satellite phone rental kit is adequately insured when returning to Chroma SATcom.

Chroma SATcom is not responsible for recipient not being available to receive delivery, incorrect addresses, phone numbers, or insufficient delivery information placed on the initial order.

Easy Return Shipping

We offer an “Easy Return Shipping” for a cost of $20.00 anywhere in Canada. If the renter pays for this service, we will include a return shipping waybill in your rental kit. When your rental period is over, stick this waybill on the box and drop it off at your nearest Purolator, UPS or FedEx drop-off location.

If renter pays for the “Easy Return Shipping” service, a grace period of five (5) days will be added to the rental period to allow for return shipping time.

Late Fees

Late fees will be charged at the rate of $15.00 per day for every day the rental equipment is not returned after the required rental period end date (inclusive of the applicable return shipping grace period.)

Cancellation Fees

Cancellation requests must be made three (3) business days prior to the scheduled start date of the order. If a cancellation is made after this date, a cancellation fee equal to 50% of the order total will be charged. If the rental equipment has already shipped, shipping costs paid by the customer will not be refunded.

Airtime Usage Billing

Billable airtime refers to voice minutes and text messages consumed in excess of what comes included with the customer’s satellite phone rental and additional minutet/text bundles that the customer may have added.

Any billable airtime charges will be billed at the end of the rental period and charged to the customer’s credit card.

If the customer prepays for any additional airtime bundles of minutes and/or text messages upon ordering their rental, then only any extra airtime consumed in excess of the prepaid amount will be billed. Unused prepaid airtime is not refundable. All billable airtime consumed during the rental period will be charged to the credit card provided by the renter on our rental agreement form.

Billable Voice & Circuit Switch Data & Calls are billed as follows:
– Minimum Call Duration = 20 seconds
– Billing Increments = 20 seconds
– Short message Service = per-message

Additional airtime information:
– All pricing is in CAD.
– Included airtime includes Iridium to Iridium, landline & cellular.
– FREE incoming text messages
– FREE incoming direct-dial to Iridium calls (caller is billed at international rates).
– Calls to check voicemail are considered outgoing calls.
– Other call/usage types are billed as per our published rates.

Security Deposit

All of our Iridium satellite phone rentals require a credit card pre-authorization for the full replacement value of the satellite phone rental hardware ($1,000.00 CAD). Government agencies and organizations with accounts in good standing are exempt from such deposits. The pre-authorization with be removed from the customer’s credit card 24-48 hours after of the rental equipment received undamaged by Chroma Satcom. If the equipment has been damaged, repair costs will be charged to customer’s credit card. The pre-authorization will be removed from the customer’s credit card once all outstanding charges (if applicable) have been billed.

Loss or Damages

The customer is solely responsible for the rented equipment during the rental period and grace period. All rented equipment must be returned to Chroma SATcom in the same condition in which it was received by the customer. If any of the rented equipment is broken, damaged, stolen, lost or missing, it is the customer is responsible to pay to Chroma SATcom a replacement or repair fee equal to the current retail price of the damaged or missing equipment. The customer understands that he or she is responsible for the full replacement cost of the equipment should it not be returned.

Satisfaction of Service

CHROMA SATCOM cannot guarrantee that the customer will be satisfied with the quality of satellite reception service. Chroma SATcom is obligated to deliver working satellite equipment to the customer by the date that the customer has indicated they need the satellite equipment. In order to be eligible for a refund for non-working equipment, the customer must; use the rental equipment to conduct a test call to the Iridium “Test Your Satellite Phone Number”, as listed in the rental instructions, immediately upon receiving the equipment, report any defective rental equipment to CHROMA SATCOM, and return the rental equipment within 48 hours of receiving it. Chroma SATcom will test the equipment that the customer has claimed to be defective and if it is found to be defective the renter will not be responsible for the rental fees. If the equipment is found to be in working condition or if the above procedure is not followed, the customer will not be granted a refund. Chroma SATcom that the customer make arrangements to receive the equipment far enough in advance of their trip that they would have sufficient time to test the equipment before their departure. Chroma SATcom makes every effort to work with customers to help them understand how to use their satellite phone or terminal and troubleshoot any apparent problems prior to the RENTER’s departure.

Service(s) Availability

Services are available exclusively within the current operating range of our service provider. Refer to the Iridium satellite network coverage details at http://www.iridium.com for more information.

Liability Regarding Service

The Customer acknowledges that use of the service for emergency, medical or other uses involving the potential for personal injury, loss of life or damage to property, is at the customer’s own risk, and that the services and/or equipment may not perform at the moment or as the customer desires. Chroma SATcom shall have no liability for any damage, loss of property, opportunity of earnings, personal injury, death or any other loss whatsoever resulting from the customer’s use of services and/or equipment, including, but not limited to, use or attempted use of 911 emergency services. This limitation applies to acts or omissions of Chroam SATcom, its suppliers, agents, employees and all persons for whom it may be responsible. Chroma SATcom does not guarantee the provision, quality and consistency of the services as provided by its suppliers and is furthermore not responsible for any interruptions, delays, inconsistencies or failures of the network or security breaches regardless of the source of any such problem including, but not limited to, Chroma SATcom’s own fault or negligence. Chroma SATcom shall not be liable to customer, nor shall customer make any claim against Chroma SATcom or its suppliers, for injury, loss or damage sustained by reason of any unavailability, delay, faultiness or failure of the facilities, equipment and/or services to be provided by Chroma SATcom pursuant to this agreement.

Operation Outside of Canada

The customer is responsible for obtaining any operating licences and authorizations that may be required and for the payment of any tariffs, duties, taxes, licensing fees, brokerage, customs, or any other fees that may be imposed on the service or equipment if it is taken or operated outside of CANADA. The customer acknowledges that the importation of satellite phone equipment and/or the use of the service is prohibited in some countries or areas.

Notices & Communications

The customer agrees that notices or other communications regarding this Agreement and the customer’s use of the service and/or equipment may be provided electronically and the customer agrees to receive communications in electronic form. Communications will be sent to the customer’s email address provided. All communications in electronic form will be considered to be “in writing” and to have been received no later than 5 business days after posting or dissemination, whether or not the customer has received or retrieved the communication. Chroma SATcom reserves the right but assumes no obligation to provide communications in paper format.
